Banerjee) Mr. Subrata Mukherjee ...for the petitioner Mr. Sharanya Chatterjee Mr. Subhajit Barman ...for the opposite parties This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Division), 3rd Court at Alipore to dispose of the repairing application expeditiously.

Learned advocate appearing for the petitioner submits that the suit property is in a dilapidated condition and requires urgent repairs. He submits that the repairing application should be disposed of expeditiously.

The opposite parties are represented by Mr. Chatterjee, learned advocate. He submits that the opposite parties have taken out an application under Order 7 Rule 11 of the Civil Procedure Code which has been heard in part and a date has been fixed hearing of such application. He further submits that

the application under Order 39 Rule 1 and 2 of the Civil Procedure Code is pending.

In the light of the submission made by the learned advocate appearing for the respective parties CO 2701 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Division), 3rd Court at Alipore to make an endeavour to dispose of the pending interlocutory applications as expeditiously as possible without granting any unnecessary adjournment to either of the parties, if the same are otherwise ready for hearing.
