Ghoshal ... petitioner in person Mr. Nilanjan Bhattacharjee ... for the Union of India The petitioner, appearing in person, submits that contrary to documents shown to the Court on the last occasion including the declaration given by the proprietor of Roy Agency that the Passport was received by one Ms. Sonia Sarkar and was handed over to Subir Kr. Roy of Roy Agency and then to Mr. Narayan Kr. Ghoshal, none of the said respondents claimed to have received the Passport. The petitioner submits that all the respondents denied having taken delivery of the Passport.

Learned counsel appearing for the Passport Authority as well as the Postal Department submit that duplicate Passport can be issued to the petitioner only upon the police coming to conclusion on an investigation being made that the Passport was lost or mis-placed in transit, the petitioner would then have to

make an application before the Passport Authority for issuance of a duplicate Passport.

The Parnasree Police Station is directed to investigate the facts of the case and file a Report as to the status of the Passport by 26th September, 2022. A copy of the Report shall be furnished to the petitioner. The order is to be communicated on the concerned Police Station. It may be recorded that the concerned Police Station shall extend effective assistance to the petitioner pursuant to the direction of this Court, which is appreciated.

The petitioner shall have the liberty of filing a fresh writ petition on being given the Report by the Police Authorities.

WPA 17541 of 2022 is disposed of in terms of the above.
