It has been brought to the notice of the Court that an appeal was preferred by the Howrah Municipal Corporation against the order passed by this Bench in MAT 249 of 2023.

The learned advocate representing the Corporation submits that the said appeal and the stay application will not be proceeded with.

The Commissioner of the Corporation by a communication dated January 17, 2024 has requested the Principal Secretary, Urban Development and Municipal Affairs Department seeking administrative approval and financial sanction for complying with the direction passed by this Court on November 21, 2022. The administrative approval and financial sanction is awaiting.

The Commissioner is directed to proceed with the matter in the right earnest to ensure that there is no

further delay in complying the direction passed by this Court.

The matter stands adjourned till May 9, 2024. An affidavit-of-compliance shall be filed on the adjourned date with an advance copy to the learned advocate representing the petitioner.
