Mr. Arijit Ganguly, learned counsel who is present in Court and usually appears on behalf of the State is requested to represent the State in this matter. The concerned authority is requested to regularize the appointment Mr. Ganguly in this matter.

Petitioners are directed to serve a copy of this application along with annexure upon Mr. Ganguly in course of this day. Heard learned counsels for the parties.

The petitioners have assailed the order passed by the learned Judge, Special 4th Court, Malda on May 21, 2024 issuing warrant of arrest against the petitioners who were absent before the learned Trial Court on the said date.

It appears that the warrant of arrest was issued against the petitioners by the learned Judge, Special 4th Court, Malda on May 21, 2024 in NDPS Case No. 18 of 2021 since the petitioners failed to appear before the Court on that date.

The petitioners undertake to appear before the learned Court within a fortnight from date.

If the petitioners surrender before the learned Trial Court within a fortnight from date and pray for bail, the learned Trial Court shall consider their application in accordance with law. Warrant of arrest issued vide an order dated May 21, 2024 be stayed till August 14, 2024.

In the event the petitioners fail to surrender before the learned Trial Court within the stipulated time frame, the learned Trial Court shall be at liberty to proceed against the petitioners in accordance with law without further reference to this Court. CRR No. 2920 of 2024 is disposed of.
