The writ petitioner claims to have been issued a letter of intent after having participated in an e-auction for allotment of a sand mining lease. It appears that there is some delay in complying with the terms of the letter of intent.

Learned Senior Counsel submits that the petitioner has made 2/3rd of the sums payable and is, therefore, entitled to a formal lease being executed in its favour. The District Magistrate, Birbhum appears to have called for a hearing which has not taken place. In that view of the matter, let the District Magistrate, Birbhum consider the representation of the petitioner dated 8th August, 2021 together with any other contentions that the petitioner may raise, in accordance with law, within a period of two months from the date of communication of a copy of this order.

The writ petitioner and/or its legal representatives shall be heard by the District Magistrate before any

decision is taken and a reasoned order may be passed and communicated to the petitioner within a period of a week thereof.

The writ petition is disposed of.

There shall be no other as to costs.
