Petitioner is directed to serve a copy of the revisional application upon Mrs. Debjani Sahu, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. Learned advocate appearing for the petitioner submits that the petitioner was arrested on 29th October, 2021, the Investigation Authorities on completion of investigation submitted chargesheet on 31st March, 2022. Charge was framed in the month of August, 2022 and till date, according to the learned advocate for the petitioner, only one witness has been examined, although the prosecution has relied upon 14 witnesses.

In view of the petitioner being in custody for more than twenty months, anxiety of the petitioner as such is justified. Accordingly, the learned trial court would take steps by directing

the Superintendent of Police of the concerned District to ensure regarding the witnesses to be present on the dates so fixed by the court. The learned court on and from the next schedule which presumably should be fixed from the month of November, 2023 after the date already fixed in the month of September, 2023 should on each and every month fix a schedule of three dates. The Superintendent of Police of the concerned District will ensure the production of all the witnesses on the date so fixed. The Public Prosecutor appearing in the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned. No unnecessary adjournments should be granted to either of the parties. All efforts be taken by the stakeholders to complete the trial at the earliest.

With the aforesaid observations, the present revisional application being CRR 2652 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. Urgent Photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
