C.R.M. (M) 1225 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Haroa Police Station Case No.

of dated 22.12.2019 under Sections 341/325/308/506/34 of the Indian Penal Code.

And In Re : Khatib Molla Fazlur Rahaman Md. Babul Hussain ... For the Petitioner.

Mr. Bidyut Kr. Roy Mr. Sujoy Sarkar ... For the State Mr. Samrat Choudhury ... For the Defacto Complainant The petitioner is in custody for more than 3 years and renews his prayer for bail.

Learned counsel for the State opposes the prayer. I have considered the material on record.

Bail granted to the petitioner was cancelled considering the material on record implicating the petitioner. The said order was affirmed by the Hon'ble Supreme Court. On merits, the petitioner does not deserve a favourable order at this stage.

Learned counsel for the petitioner submits that despite specific direction of this Court only 4 out of 24 witnesses have been examined till date.

Considering the material on record, prayer for bail is rejected at this stage.

Learned trial Court is directed to expedite the trial Court without granting any unnecessary adjournment to either of the parties.

The application for bail is disposed of.

Case diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
