05-08-2022 AKG WPA 17577 of 2022 Riddhima Biswas Ct. 21 Vs.

The Union of India & Ors.

Mr. Kallol Basu, Mr. Arindam Chattopadhyay, Mr. Lipika Chatterjee, Mr. Soumik Dey ...For the Petitioner Mr. U. S. Menon, Mr. Abhirup Chakraborty ...For the Respondent Nos. 2 & 3 Mr. Dibashis Basu, Mr. Arun Bandyopadhyay ...For Union of India The petitioner participated in the Joint Entrance Examination (Main) 2022 as a 'General' category candidate. The advertisement for the said examination was published in the website of National Testing Agency on 1st March, 2022. Last date for submission of the application was 31st March, 2022.

The petitioner claims that "Economically Weaker Section" certificate issued in her favour by the SubDivisional Officer, Tehatta, Nadia on May 24, 2022 should be considered by the respondent for placing her in the merit list since she has obtained the said certificate before the date of examination which was scheduled to be held on June 27, 2022.

It is clear that the petitioner did not obtain the "Economically Weaker Section" certificate before the last date of submission of the application as indicated in the

advertisement. Therefore, the said certificate could not be considered by the National Testing Agency. The law has been settled in this regard in the judgment reported at (1997) 4 SCC 18 (Ashok Kumar Sharma v. Chander Shekhar).

Since the petitioner was not equipped with the "Economically Weaker Section" certificate before 31st March, 2022, the said certificate has rightly not been considered by the respondents.

In that view of the matter, I am not inclined to entertain this writ petition.

Accordingly, WPA 17577 of 2022 is dismissed.

Let urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
