The two applications, one for quashing of the proceeding on the ground of compromise and the other seeking anticipatory bail have been taken up for hearing together.

Report filed on behalf of the State in CRM (A) 2407 of 2025 is taken on record.

Learned counsel appearing on behalf of the petitioner submits as follows. During pendency of the proceeding, a settlement and compromise was arrived at between the private parties of all disputes that had led to the registration of the FIR. In fact, there was a misunderstanding, which was clarified later and the accused petitioner and the victim/private opposite party have got married. The marriage was duly registered on 22.08.2025.

Learned counsel appearing on behalf of the de facto complainant supports such contentions of the petitioner and submits that in view of such settlement, the impugned proceeding may be quashed.

Learned Counsel appearing on behalf of the State in CRM (A) 2407 of 2025 submits that the Investigating Officer had recorded a further statement of the alleged victim where she stated that the case was started due to some misunderstanding. Subsequently, a marriage was duly solemnized between the private parties. A letter was also given to the Police Station in this regard. 6.
Heard the learned counsel appearing on behalf of the State in CRR 3279 of 2025 as well.

It appears that a settlement and compromise has been arrived at between the private parties and the accused petitioner has got married to the de facto complainant/opposite party.

In view of the above and in the interest of justice, I quash the impugned proceeding in DR Case No.1448 of 2025 pending before the learned Additional Chief Judicial Magistrate, Kalyani, Nadia arising out of Chakdah Police Station Case No.98 dated 01st February, 2025 under Section 69 of the BNS. 9.
After quashing of the impugned proceeding, the application for anticipatory bail in respect of the same has become infructuous. 10.
Accordingly, both the applications and the connected application are disposed of.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
