The petitioner seeks parity with the co-accused who have been granted bail by this Court earlier.
Learned counsel for the State does not oppose the said fact. Opposing the prayer, learned counsel for the defacto complainant submits that the bail prayer of the petitioner was turned down by this Court on 4th March, 2025. It appears that after rejection of the bail prayer of the petitioner, co-accused similarly circumstanced with the petitioner have been granted bail by this Court.
In view of the above, the petitioner also deserves the same benefit.
Accordingly, the prayer for bail is allowed.
The petitioner namely Minarul Sk @ Minaj Sk be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be
local, to the satisfaction of the learned Chief Judicial Magistrate, Nadia at Krishnanagar subject to the condition that he shall appear before the learned trial Court on every date of hearing. He shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
In the event the petitioner fails to appear before the learned trial Court on any date without justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
