Petitioner is aggrieved by the continuance of the criminal proceedings arising out of Pukhuria PS Case No. 527/2023 dated 17.11.2023. The plea taken up by the petitioner relates to certain facts in order to improbabalise the prosecution case.

Learned advocate appearing for the State submits the reports made available to him by the police authorities.

It has been submitted that charge sheet has already been filed before the jurisdictional court under section 302 of the Indian Penal Code along with other sections.

Having considered that the charge sheet has already been submitted before the jurisdictional court, I am of the view that the petitioner would address his grievance at the time of consideration of charges before the learned Sessions Court which would be in seisin of the issues. At this belated stage, there is no scope for interference so far as the legality of the FIR is concerned.

Accordingly, WPA 17944 of is disposed of.

Report so submitted be kept with the record.

A copy of the report without annexures be handed over to the learned advocate appearing for the petitioner.
