1) Heard learned advocate for the petitioner and learned Public Prosecutor.

2) We find that similar such prayer of the present accused petitioner was rejected only on May 9, 2024 by a Coordinate Bench of this Court.

3) In absence of any supervening circumstances, we are not inclined to exercise our discretion under Section 439 Cr.P.C. in favour of the present accused petitioner.

4) CRM (NDPS) 1128 of 2024 is dismissed.
