Report submitted by the learned advocate appearing for the State be also kept with the record. Petitioners are aggrieved by the inaction of the police authorities as according to them, the private respondents have been disturbing the peaceful enjoyment of their property and to that effect, several intimations have been advanced to the police authorities, but till date no steps have been taken.
Learned advocate appearing for the private respondents submits that already police authorities have drawn up proceedings and the police authorities have also implicated the petitioners in the said proceedings.
Considering the fact that proceedings under Sections 126/135(3) of BNSS have been drawn up, the police authorities would keep their surveillance
and ensure that no breach of the peace and/or tranquility takes place at the locale.
Police authorities would also ensure that if there are civil disputes, parties should approach the civil court for necessary remedies.
Police authorities would restrict themselves in exercising their powers as has been directed above.
With the aforesaid observations, the writ petition being WPA 17066 of 2025 is disposed of. There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
