M/L Mr. Amal Kumar Mukhopadhyay Mr. Subhendu Bandyopadhyay .......For the Petitioner Mr. Ratul Biswas Mr. Kaushik Chowdhury ......For the Board The case of the petitioner is that her husband while working as a teacher in a primary school became seriously ill and he had to stay in leave on and from 22.01.1981 to 08.05.1985. Then he went to join the school but he was prevented. Thereafter several representations were made and letters were given by the husband of the petitioner but without any result. Husband of the petitioner retired from service in 2007. He expired in the year 2012. The petitioner now prays as the wife of the deceased employee her widow pension and other retiral benefits, which has not been given for quite some time.

I direct the District Inspector of Schools (Primary Education) to give an opportunity of hearing to the petitioner to settle the matter. While giving an opportunity of hearing, as has been directed, the D. I.

of Schools (P. E.) will take into account all the relevant annexures made in the writ application. The D. I. of Schools (P. E.) will give an opportunity of hearing to the petitioner within a period of sixty days from the date of communication of this order and to pass a reasoned order after the hearing by two weeks thereafter. The hearing may be given for more than one day but not more than three days in the said sixty days period.

I am told by the learned for the Howrah District Primary School Council (D. P. S. C.) that the said D. P. S. C. requested the petitioner to supply some papers which are not in the hands of the D. P. S. C. which has not been supplied till now. However, the petitioner has replied that all papers which are in the hands of the petitioner annexed to the writ application.

With the above observation and direction the writ application is disposed of.

In the event the petitioner is found entitled to the family pension and other retiral benefits for his deceased husband, the respondents will take appropriate steps for payment of the same.
