24.09.2025 SB Rejected C.R.M. (NDPS) 944 of 2025 In Re:- An application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection Raina Police Station case no. 172 of 2025 dated 23.4.2025 under Sections 20(b)(ii)(c)/29 of the NDPS Act 1985.

And In the matter of : Aduri Jash .... Petitioner Mr. Palash Bapari ...for the Petitioner Mr. Anand Keshari Mr. Atulya Sinha ...for the State Prosecution case is that 46.6. kgs. of ganja was recovered from the joint possession of the present petitioner and one Manu Bibi.

Leaned counsel for the petitioner submits the petitioner is in custody for about five months and though the charge has been framed against the accused person but the examination of witness has not yet been started and as such, she may be released on bail on any terms and conditions. Learned counsel for the State opposed the bail prayer contending that the commercial quantity of contraband was recovered from the possession of the present petitioner and the examination of witness before the Trial court is going to be commenced shortly. He further submits that the petitioner has criminal antecedent.

Having considered the submissions made on behalf of both the parties and considering the materials placed before me, I find that the petitioner failed to overcome the restrictions imposed under Section 37 of the NDPS Act and as such, the prayer for bail made by the petitioner is rejected. The Trial court is requested to expedite the trial and to come to a logical conclusion at the earliest. Accordingly, CRM (NDPS) 944 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
