The petitioner is a retired employee of Raghunathpur Municipality. He joined service on December 13, 1999 and retired on February 28, 2023. He submits that his provident fund amounting to Rs. 1,58,219/- only has not been paid to him. The petitioner made representation requesting payment of the provident fund amount. The same has not been considered till date.

None represents the Municipality.

Affidavit-of-service filed in Court today is taken on record.

As it appears that the Pension Payment Order has been issued in favour of the petitioner and it has been certified by the Municipality that the aforesaid amount is available on account of his provident fund, accordingly, the Municipality is directed to take steps for payment of the provident fund amount which is due and payable to the petitioner at the earliest but positively within a period of ninety days from the date of communication of this order.

In the event, the aforesaid amount is not paid within the time as stipulated hereinabove, the petitioner will be entitled to receive the aforesaid amount along with interest on account of the delayed payment @ 7%

per annum which will be calculated on and from the date the same fell due till the date of actual payment. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
