Case No. 396 of 2022 dated 30.06.2022 under Sections 302/34 of the Indian Penal Code read with Sections 25/27 of the Arms Act and Sections 3/4 of the Explosives Substances Act.

1. Petitioner is in custody for more than 2 year. Most of the vital witnesses who have been examined have not supported the prosecution case.
2. Under such circumstances no worthwhile purpose would be served in continuing the detention of the petitioner. Hence, we are inclined to grant bail to the petitioner.
3. Accordingly, we direct the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Murshidabad At Berhampore subject to the condition that the petitioner shall appear before the trial court on each and every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.
4. In the event petitioner fails to appear before the Trial Court without any justifiable cause, the Trial Court shall be at liberty to cancel his bail without any further reference to this Court. Signed By :
