Learned advocate appearing for the petitioners submit that, some of the accused were granted bail and some others were granted anticipatory bail.
Learned advocate appearing for the State draws the attention of the Court to the materials in the case diary including the statement recorded under Section 164 of the Code of Criminal Procedure (Cr. P. C.).
Considering the materials in the case diary and considering the gravity of the offence and the involvement of the petitioner and considering the fact that the petitioners are named in the statement recorded under Section 164 of the Cr. P. C. as one of the principal assailants, we are unable to grant anticipatory bail to the petitioners.
Accordingly, prayer for anticipatory bail of the petitioners is rejected and the application being CRM 7495 of 2021 is dismissed.
