Learned advocate appearing for the petitioner submits that he is innocent of the charges and has been falsely implicated in connection with the instant case.

Learned advocate submits that the allegations complained of in the chargesheet do not make out any offence so far as the petitioner and none of the victim ladies have been named in the present petition for proceeding against him in respect of the alleged offences. It has also been submitted that the petitioner has been made a victim of business rivalry and has been falsely implicated in connection with the instant case.

Calcutta opposes the prayer advanced by the learned advocate for the petitioner.

Learned advocate for the State submits that on completion of investigation, other offences under Sections 376/370/372/373/34 of the Indian Penal Code; Sections 3,4 & 5 & 7 of the Immoral Traffic(Prevention) Act with Sections 4, 8, 12, & 17 of the Protection of Children from Sexual Offences Act along with Section 75 of the Juvenile Justice( Care and Protection of Children) Act, 2015. Learned advocate further submits that there are materials appearing against the present petitioner.

Having considered the rival submissions advanced by the learned advocates appearing for the parties, I am of the opinion that the petitioner would be at liberty to canvas the points advanced in the present revisional application at the appropriate stage of the proceedings before the learned special court. With the aforesaid observations, the present revisional application being CRR 2303 of 2021 is disposed of.
