Criminal Revisional Jurisdiction 24-07-2023 Item no.29 Subrata Bhattacharyya CRR No.2658 of 2023 Amar Nath Koley -vsThe State of West Bengal Mr. Kingsuk Mondal ...for the petitioner Mr. Sanjay Bardhan Ms. Baishakhi Chatterjee ... for the State I have considered the subject-matter of challenge before this court being a judgement dated June 22, 2023 passed by the learned Additional Sessions Judge, Chandernagore, Hooghly in Criminal Revision No.11 of 2023 wherein the learned court was pleased to direct the petitioner to furnish a bank guarantee. The petitioner is aggrieved regarding the quantum of bank guarantee so fixed by the learned court below.

Having considered the pros and cons of the issues involved, I am not inclined to interfere with the conditions so imposed by the learned Additional Sessions Judge, Chandernagore, Hooghly in Criminal Revision Case No.11 of 2023, except to the extent that the opposite party being the Excise Department of the State will not hold auction on or before August 3, 2023, if the petitioner, by August 2, 2023, is able to furnish the bank guarantee and comply with the conditions. The department and the learned Magistrate would follow the observations made in the said criminal revision case by the learned Additional Sessions Judge on June 22, 2023. CRR No.2658 of 2023 is, thus, disposed of.

Pending application, if any, is consequently disposed of. Parties are to act on the server copy of this order duly downloaded from the official website of this court.
