Misc. Case No. 2 of 2023 expeditiously.
The learned advocate appearing for the petitioner submits that the wife/opposite party herein filed an application under Section 24 of the Hindu Marriage Act which was registered as J. Misc. Case No. 2 of 2023. He further submits that on account of pendency of the J. Misc. Case, the hearing of the matrimonial suit filed by the husband/petitioner herein is being delayed.
In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite party. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge.
From the ordersheets appended to this application this Court finds that 23rd September, 2025 has been fixed
for filing additional written statement by the respondent and for filing of affidavit of assets and liabilities by both the parties.
In view thereof, C.O. 2706 of 2025 stands disposed of by requesting the learned Judge, Family Court, Tamluk, Purba Medinipur to make an endeavour to dispose of J. Misc. Case No. 2 of 2023 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
