In Re : Biswajit Saha .....petitioner Mr. Pradyot Kumar Das ...... for the petitioner The instant revisional application has been filed seeking a direction for the expeditious disposal of Ghola Police Station Case No. 162 of 2016, under Sections 498A/406 of the Indian Penal Code, corresponding to G.R. No. 2380 of 2016.
Mr. Das, learned Advocate appearing for the petitioner, submits that the present case requires expeditious disposal. He submits that based on a complaint lodged by the O.P. no. 2 against the petitioner and his relatives, Ghola Police Station Case No. 162 of 2016 dated 10th April, 2016 under Sections 498A/406 of the Indian Penal Code was initiated. Upon conclusion of the investigation, charge-sheet being No. 155 of 2016 dated 30th April, 2016 was submitted, which was brought on record on 4th January, 2017. The order dated 4th January, 2017 also indicates that cognizance of the offence was taken on that date. He further submits that although more than eight years have passed since then, the charge has not yet been framed. Accordingly, he prays for a direction upon the learned Court below for expeditious disposal of the case.
Having regard to the submissions made on behalf of the petitioner and upon perusal of the materials on record, I am of the view that there is no purpose in keeping the present revisional application pending.
As noted earlier, in the present case, the FIR was lodged on 10th April, 2016 and the charge-sheet was taken on record on 4th January, 2017. On 4th June, 2017, a date was fixed for framing of charge. However, since 2020 till date, the charge has not been framed, and the matter has now been adjourned to 17th April, 2026 for that purpose. Taking note of the above facts and considering the overall circumstances of the case, the present revisional application is disposed of with a direction upon the learned Court below to ensure that the charge is framed on the next date fixed, i.e., 17th April, 2026, positively. The learned Court below is further directed to make a sincere effort to dispose of the case as expeditiously as possible, preferably within a period of one year from the date of framing of charge.
With this observations and order, this revisional application is, thus, disposed of.
