Affidavit-of-service filed on behalf of the petitioner is taken on record.

By the present writ petition, the petitioner seeks to include his name in the merit list of Primary Teachers Recruitment Process, 2009.

The petitioner contends that he participated in the Primary Teachers Recruitment Process, conducted by the District Primary School Council, North 24-Parganas. The petitioner was successful in the written examination and was called for interview. The petitioner by way of an RTI application came to know that the total marks of the petitioner is 14.15 whereas the candidates securing less marks have been given appointment. On 26th June, 2024, the petitioner made a representation for his enlistment, however no steps have been taken. Hence, this writ petition seeking for appropriate order for enlistment of the

petitioner in the merit list pertaining to Primary Teachers Recruitment Process, 2009 conducted by the District Primary School Council, North 24-Parganas. 4.

Mr. Raja Biswas, learned Advocate for the petitioner submits that specific direction be issued upon the District Primary School Council to enlist the petitioner in the merit list.

Mr. Pinaki Bhattacharya, learned Advocate for the District Primary School Council, North 24-Parganas submits that writ petition is not maintainable since the writ petition is filed beyond the cut off date fixed by the coordinate Bench of this Court passed in Kakali Mondal & Ors. versus The State of West Bengal & Ors. (In Re: WPA 20966 of 2022) along with batch of other writ petitions vide order dated 25th April, 2024. He seeks for dismissal of the writ petition.

By order dated 25th April, 2024, upon observing irregularities and improprieties in the recruitment process of 2009, the coordinate Bench in Kakali Mandal (supra), issued the following direction: "13. In the above circumstances, following the order dated 9th April, 2024 passed in WPA 3268 of 2015 (Sourav Naskar and Ors. Vs. State), for the reasons stated therein, in respect of the DPSC, Howrah, this Court by consent of all parties, is inclined to direct the all candidates who were called for interview in the aforesaid recruitment process of the year 2009 and have filed writ petitions until 24th April, 2024, shall be entitled to appointments against existing or future vacancies."

Though the petitioner was called for interview, however writ petition has been filed on 25th June, 2025 i.e. beyond the cut off date fixed till 24th April, 2024 by the coordinate Bench of this Court. Hence, the writ petition falls short of merit.

Accordingly, the writ petition being WPA 17108 of 2025 stands dismissed.

Interim order, if any, stands vacated.

10. All connected applications, if any, stand disposed of.

11. There shall be no order as to costs.

12. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

13. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
