Heard learned counsels for the parties.

The petitioner is in custody for more than 100 days and prays for bail. Learned counsel for the petitioner submits that the petitioner is a disabled person with Post Polio Residual Paralysis at the left upper limb. Charge sheet has been submitted. His further detention is not required. The incident occurred on the spur of the moment between neighbours pursuant to a dispute with regard to the obstruction of a common pathway.

Learned counsel for the State opposes the prayer. I have considered the material on record. The petitioner allegedly stabbed the victim with a knife. The victim suffered penetrating wound in the mid upper abdomen.

Considering the nature of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
