1. With the consent, finally heard.

2. During the course of hearing, learned counsel for the parties reached to a consensus.

3. It is agreed that this PIL may be disposed of by reserving liberty to the petitioner to prefer a fresh comprehensive representation against the impugned order dated 28.06.2022 issued by Principal Chief Conservator of Forests, if he is still aggrieved.

4. The said representation be preferred before the Department of Forest, Government of West Bengal, who has issued the order dated 11.12.2019 along with the copy of this order.

5 In that event, the Joint Secretary/competent authority of Department of Forest shall consider and decide it by a reasoned order within 60 days.

6. It will be open to the said authority to hear the affected parties (if any) before taking a final decision.

7. In view of the consensus arrived at, this PIL is disposed of by directing the parties to act in accordance with their stand taken hereinabove.

8. It is made clear that this Court has not expressed any opinion on the merits of the case. ( SUJOY PAUL, J. ) ( SMITA DAS DE, J. )
