Heard learned counsels for the parties.

The petitioner is in custody for more than 200 days and prays for bail.

Learned counsel for the petitioner submits that the petitioner is not the principal assailant and co accused similarly circumstanced with him have been granted bail earlier.

Learned counsel for the State opposes the prayer. I have considered the material on record. The co accused who are on bail are ladies. The petitioner cannot claim parity with them. Statement of the injured witness and other witnesses implicate the petitioner in the murderous assault. One of the victims succumbed to the injuries sustained by him. Charge sheet has been submitted.

Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
