1. Report submitted in the form of an affidavit by the respondent no. 2 is taken on record.

2. The instant writ petition relates to the subject matter of grant of higher pay scale to the petitioner pursuant to his enhanced qualification in Master Degree.

3. It is pertinent to mention that the Hon'ble Larger Bench of this Court vide judgment of (Utpal Kanti Karan-vs-State of West Bengal 2024 SCC Online Cal 1274) has now settled the law and set the issues as are involved in the instant writ petition, at rest.

4. Hence, let this writ petition be disposed of with the direction upon the petitioner to file the comprehensive representation before the respondent no. 3/the Commissioner of School Education elaborating his prayer and grounds thereof.

5. Let the said respondent i.e. the Commissioner of School Education, Government of West Bengal

consider the representation of the petitioner when submitted, in the light of the ratio of the decision of the Hon'ble Larger Bench of this Court as mentioned above.

6. Let it be mentioned that in doing so, the State respondent shall afford opportunity of hearing to the petitioner and pass a reasoned order, if not the prayer of the petitioner is immediately allowed by him.

7. Let the entire exercise as above, be concluded by the respondent no. 3 within a period of four weeks from the date of submission of the comprehensive representation by the petitioner before the said respondent.

8. With the above observations and directions the writ petition being WPA 18236 of 2021 is disposed of.

9. Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents including the private respondents.

10. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
