Mr. Swapan Banerjee, learned advocate appearing for the State files a report of the concerned officer of Hare Street Police Station. The said report dated 29.09.2021 be kept with the record.

The report reflects that on conclusion of investigation, final report was submitted on the foundation that there was want of evidence and as such, accused persons were discharged from the instant case. However, pursuant to the order passed by this Court on 24.09.2021, further statement of the complainant was recorded. The said statement reflects that the complainant has categorically stated that there has been amicable settlement and he is not willing to pursue the litigation.

Having regard to the dispute and differences being private and personal in nature, I am of the view that all

further proceedings relating to Hare Street Police Station Case No. 130 of 2018 dated 18.05.2018 should be quashed. Accordingly, the prayer advanced in CRR 2471 of 2018 along with CRAN 5 of 2021 is hereby allowed.

Pending other application, if any, is consequently disposed of.
