Learned advocate appearing for the State submits that commercial quantity of narcotic was seized from the possession of the petitioner.

The forensic examination report was subsequently submitted with the jurisdictional court by way of supplementary charge sheet.

Considering the fact that commercial quantity of narcotic was seized from the possession of the petitioner, we are of the view that petitioner is unable to overcome the restriction under Section 37 of the N.D.P.S. Act, 1985. Moreover, there is hardly any change in circumstances since the earlier order of rejection.

We are unable to grant bail to the petitioner. CRM 7600 of 2021 is rejected.
