For the Petitioner Though the petitioner initially sought quashing of proceeding being ML/05/2019 pending before the learned Chief Judge, City Sessions Court, Calcutta, the petitioner presently expresses his concern with regard to the order dated 6th June, 2024 directing issuance of warrant of proclamation against him. Heard learned counsels for the parties.

The petitioner was granted bail by the learned Judge on 25th July, 2019 but failed to appear before the learned Court on several occasions for which warrant of arrest was issued against him. Since the warrant of arrest could not be executed, the investigating agency submitted non execution report on the basis of which warrant of proclamation has also been issued. The petitioner undertakes to surrender before the learned Court within 7 days from date. If the petitioner surrenders before the learned trial Court within 7 days from date and files an application for bail, the learned Court shall deal with the same in accordance with law. In the event the petitioner fails to surrender before the learned trial Court within the stipulated time frame, the learned Court shall be at liberty to take necessary steps against the petitioner in accordance with law without further reference to this Court.

Warrant of proclamation issued against the petitioner on 6th June, 2024 be stayed till 24th January, 2025.

Since nothing further remains to be adjudicated in the present application, the same is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
