For the writ petitioner/ respondent Records reveal that a writ petition being WPA 3409 of 2022 preferred by Smt. Panwa Bhuia was disposed of by an order dated 22nd September, 2022. By the said order, the Court arrived at a finding that the writ petitioner was entitled to 'MMCC' as per the provisions the National Coal Wage Agreement. Aggrieved by the said order, an appeal was preferred by Eastern Coalfields Limited (in short, ECL) and its functionaries being FMA 98 of 2023.

The said appeal was dismissed by an order dated 28th June, 2023. Challenging the same, ECL and its functionaries again preferred a Special Leave Petition which was disposed of by an order dated 31st July, 2023 granting two weeks time to the petitioners therein to comply with the order passed by the High Court.

Records further reveal that alleging non-compliance of the order passed by the learned single Judge on 22nd September, 2022, a contempt application being CPAN 82 of 2023 was preferred by the writ petitioner in which Rule

was issued on 7th July, 2023. Challenging the said order, the present appeal has been preferred.

In course of hearing, Ms. Banerjee, learned advocate appearing for the appellants submits that the order passed by the learned single Judge on 22nd September, 2022 has already been complied with and the learned single Judge has also disposed of the contempt application and discharged the Rule.

Such contention has not been disputed by Mr. Ghosh, learned advocate appearing for the writ petitioner/respondent.

In view thereof, no further interference is called for in the present appeal and the same along with the connected application is disposed of.
