Ct. No. 655 s.g.

CO/2465/2015 Sk. Hamidur Rahaman & Ors.

Vs.

Asura Bibi & Ors.

1.

Both the parties are not represented.

2.

It appears that the instant revisional application is preferred at the behest of the petitioners challenging the impugned order dated 29th April, 2015 passed by the learned First Appellate Court in connection with Misc. Appeal No. 434 of 2012. By passing the impugned order the learned First Appellate Court reversed the order dated 3rd September, 2012 passed by the learned Trial Court in connection with Title Suit No. 20396 of 2012. 3.

It further appears that during pendency of this revisional application petitioner no.1 as well as opposite party no. 7 were expired and the petitioners were directed to take appropriate step in the case of death of those parties to the case by passing an order dated 06.02.2024 by this Court. No step has yet been taken on behalf of the petitioners.

4.

It is reasonably presumed that the present petitioners have lost interest to proceed further with the present case. So, there is no option left but to dismiss the present revisional application.

5.

Accordingly, being C.O. 2465 of 2015 is dismissed for default.

6.

Interim order, if any, stands vacated.

7.

There will be no order as to costs.
