The prayer of the petitioner seeking transfer on medical grounds is pending consideration at the end of the Secretary, West Bengal Board of Primary Education. The petitioner has annexed certain medical documents with the writ petition.

It has been submitted that she has to travel at least 140 kms. per day to attend school and with her medical condition it is not advisable for her to travel such long distance.

It has further been submitted that the petitioner is a surplus teacher in the present school and there is no impediment to release her.

Without entering into the merit of the claim of the petitioner the instant writ petition is disposed of by directing the Secretary, West Bengal Board of Primary Education to consider the prayer of the petitioner in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter. Learned advocate for the petitioner is directed to forward a copy of the representation along with all medical documents in support of her prayer to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.
