1. In terms of order dated 28th August, 2025 a report dated 8th September, 2025 of the District Inspector of Schools (SE) Nadia is placed before this Court and same is taken on record.

2. Mr. Saibal Acharyya, learned advocate representing the State respondents in reference to a memo dated 27th August, 2025 has submitted that relevant documents along with calculation sheet, input sheet, service book and pension booklet were forwarded to the Assistant Director, Pension, Provident Fund and Group Insurance for processing claim of the petitioner. According to the State respondents now Directorate of Pension, Provident Fund and Group Insurance based on relevant documents needs to take decision on the claim of the petitioner seeking release of arrear pension as 3% additional incremental

benefits were allowed to the petitioner by the Additional Secretary, School Education Department vide order dated 30th October, 2024.

3. Question arises whether vide memo dated 27th August, 2025 District Inspector of Schools (SE) Nadia has forwarded the undertaking which petitioner furnished in terms of the order dated 30th October, 2024 of the Additional Secretary, School Education Department, or not.

4. On perusal of memo dated 27th August, 2025 it is not clear whether undertaking furnished by the petitioner before the District Inspector of Schools (SE) was forwarded to the Directorate of Pension, Provident Fund and Group Insurance. If aforesaid undertaking is not forwarded till date District Inspector of Schools (SE) Nadia being respondent no. 4 is directed to forward the same by 7 (seven) days from the date of communication of this order.

On receipt of undertaking and other relevant documents which Directorate of Pension, Provident Fund and Group Insurance has already received vide memo dated 27th August, 2025, Director of Pension, Provident Fund and Group Insurance being respondent no. 7 shall pass necessary order for release of arrear pension within a period of 4 (four) weeks thereafter. Decision to be taken by the

respondent no. 7 shall be communicated to the petitioner by 10 days thereafter.

6. Learned advocate representing the petitioner has also submitted that in view of granting 3% additional incremental benefits petitioner is also entitled to receive arrear salary.

7. Leave is granted to the petitioner to make a representation to the respondent no. 4 by fortnight from date. If such representation is made respondent no. 4 shall decide the same in accordance with law within a period of 6 (six) weeks thereafter.

8. Writ petition stands disposed of.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
