The subject-matter of challenge was the order dated 17.02.2011 passed by the learned Judicial Magistrate, 5th Court, Barrackpore in M. Case No.89 of 2010.

Records of the revisional application reflect that the learned court on an appreciation of the materials placed before him was pleased to award maintenance of Rs.2,000/- per month to the wife and Rs.2,000/- per month to the daughter. Having regard to the quantum which was awarded by the learned Magistrate by way of interim measure during the pendency of the main consideration of the application under Section 125 of the Code of Criminal Procedure, I am of the view that no interference is called for at this belated stage. Accordingly, CRR 2380 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

The private opposite party will be entitled to recover the arrears by taking an appropriate application before the learned Magistrate.
