1. Learned counsel appearing for the petitioner submits petitioner is in custody over a year. He submits he was not present at the place of occurrence and has been falsely implicated as a conspirator on mere suspicion. He prays for bail.

2. Learned counsel appearing for the State opposes the bail prayer. He contends petitioner had hatched a conspiracy to murder the victim. He prepared a sketch map of the locality which was recovered from the co-accused. He had also played a role in procuring fire arms.

3. We have considered the materials on record. There are ample materials showing involvement of the petitioner in the conspiracy to murder the victim. Charges have been framed. Recording of evidence is about to commence.

4. Under such circumstances, release of the petitioner may adversely affect the progress of trial and impact the safety and security of witnesses.

5. Accordingly we are not inclined to grant bail to the petitioner.
