The revisional application was preferred against the issuance of summons in respect of a proceeding being Complaint Case No.151 of 2011 pending before the learned Judicial Magistrate, 2nd Court, Sealdah under Sections 420/120B of the Indian Penal Code.
Having regard to the fact that there has been no progress in the case because of the pendency of the present revisional application, I am of the view that the complainant should be afforded an opportunity to adduce evidence before charge. Consequently, the revisional application being CRR 2387 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
