The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The appellant of Title Appeal No. 30 of 2021 pending before the 3rd Court of learned Additional District Judge, Howrah is the petitioner of the instant application under Article 227 of the Constitution of India. The said appeal since was filed out of time, an application under Section 5 of the Limitation Act has been taken out.

The petitioner is complaining that in spite of a direction of expeditious disposal of the said application passed by a coordinate Bench of this Court in CO 2876 of 2023 on September 14, 2023, the same has not yet been disposed of.

The petitioner is praying a similar direction again. A direction to the same effect since is already there, no further direction as prayed for is necessary.

The appeal court below however is requested to adhere to the earlier direction.

C.O. 2502 of 2024 is disposed of with the above terms without any order as to costs.
