2021-12-06Hon'Ble Justice Moushumi Bhattacharya2 pages

Ct. 05 Item No.43 06.12.2021 (suvendu) WPA 18267 of 2021 [Via Video Conference] Nikita Rajak Vs.

The Secretary, Department of Higher Education & Ors.

Mr. Subir Sanyal Mr. Ratul Biswas Mr. Kaushik Chowdhury ......for the petitioner Mr. Raja Saha Mr. Nilotpal Chatterjee Mr. S. Banerjee ........for the Calcutta University The only prayer in the writ petition is for a direction on the respondent authorities, being the University of Calcutta, to issue the Part -I Supplementary Result in Mathematics to the petitioner with immediate effect.

During the course of submissions, learned counsel appearing for the petitioner submits that the results of the Part -I Examination has already been given to the petitioner but that the result of Part -III Examination in Mathematics has not yet been disclosed.

Learned counsel appearing for the University of Calcutta points to the averments

made in the writ petition as well as to the prayer therein.

Upon hearing learned counsel, this Court is of the view that the only prayer in the writ petition is for issuing the Part -I Supplementary Result in Mathematics to the petitioner. Besides this, paragraph -9 of the writ petition clearly states that the petitioner gave her Part -III Examination through Online Mode and has also obtained her result for Part -III Examinations in 2021.

For the above reasons, there cannot be any further issue that remains in the writ petition and the same is disposed of accordingly.

It is made clear that the petitioner shall be treated as having sat for and qualified in all 3 Parts of the examination and the University is directed to proceed on that basis.

Urgent certified copy of this order, if applied for, be given to the parties on usual undertakings.
