Supplementary affidavit filed by the petitioner is taken on record.

The petitioner has assailed the order passed by the learned Judicial Magistrate, 3rd Court, Alipore, South 24 Parganas on 13th May, 2024 in M. Execution Case No.370 of 2016. In the said order the learned Magistrate has recorded that warrant of arrest issued against the petitioner shall be recalled upon payment of Rs.20,000/- by the petitioner.

The petitioner undertakes to pay Rs.20,000/- to the opposite party by the next date of hearing fixed before the learned Trial Court.

This Court notices that by an order passed on 8th February, 2024 in CRR 401 of 2024 filed by the present opposite party, this Court directed the learned Trial Court to fix at least one date in a month and fix a schedule of installments so that the petitioner therein (opposite party)

gets a complete picture regarding the time frame within which the arrears accrued shall be cleared.

It cannot be ascertained whether the said order has been complied with by the learned Trial Court. The learned Trial Court is directed to comply with the said order in its true letter and spirit on next date of hearing fixed before him.

In view of the above, the revisional application being CRR 2932 of 2024 is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
