Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of the statement made by the coaccused and he is in custody for 325 days. According to the petitioner, the principal accused from whom the recovery has been made was released on bail by the learned Trial Court on 11.02.2025. As such, on any stringent condition the petitioner may be released on bail.

Learned advocate appearing for the State opposes the prayer for bail.

I have taken into account the materials available in the case diary.

Having considered the fact that the petitioner was arrested on the basis of the statement made by the co-accused, I am of the opinion that further custodial detention is unwarranted at this stage.

Accordingly, the prayer for bail of the petitioner is allowed. 6.

As such, the petitioner, namely, Mamun Mandal @ Mamunur Rasid Mondal shall furnish bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge (under NDPS Act) -cum- Additional District & Sessions Judge, 3rd Court, Balurghat, Dakshin Dinajpur. 7.

If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Dakshin Dinajpur without prior permission of the learned Special Court.

Accordingly, CRM(NDPS) 950 of 2025 is disposed of. 9.

Case diary be returned to the learned advocate appearing for the State.

10. All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court.

11. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
