Mr. Niladri Sekhar Ghosh Mr. Shaharayar Alam Ms. Laboni Sikder Mr. Souvik Dey ...for the petitioners Mr. Dipankar Paramanick ..for the de facto Mr. Arindam Sen Ms. Suveni Banerjee ...for the State Copy of an order dated 08.09.2025 passed in G.R. 2006 of 2025 as filed on behalf of the petitioners is taken on record. Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the parents in law and brother in law of the alleged victim deceased. The couple stayed elsewhere and the petitioners are not responsible for commission of the alleged offences. During pendency of this application, the prime accused being the husband surrendered before the learned jurisdictional Court and was taken into custody.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the case diary and submits that the incident took place within three months of the marriage.

Considering the above and the materials available in the case diary and the fact that during pendency of this proceeding, the husband being the principal accused surrendered before the learned jurisdictional Court and was taken into custody, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the application for anticipatory bail of the petitioners is allowed.

However, in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioners shall not threaten or intimidate witnesses and shall co-operate with investigation. The petitioner no.1 shall meet the I.O. once a fortnight till submission of report in final form.

The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
