24.07.2023 sdas rejected C.R.M. (DB) No. 2925 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Swarupnagar Police Station Case No. 401 of 2022 dated 20.04.2022 under Sections 188 of the Indian Penal Code and Section 14 of the Foreigners Act and Section 12 of Passport Act.
And In Re : Sunil Das ..... petitioner Mr. Gobinda Chandra Baidya ... for the petitioner Ms. Anasuya Sinha Mr. Mayukhi Mitra ... for the State Heard the learned Counsel for the parties.
We have considered the materials on record. Petitioner is a foreign national. Documents annexed to the petition in support of his plea of citizenship do not inspire our confidence nor it can be said to have clinching evidentiary value on the aforesaid issue. Co-accused who had been enlarged on bail had absconded resulting in delay. In view of the aforesaid circumstances and the nature of allegation we are not inclined to grant bail to the petitioner.
The application for bail is, thus, rejected.
