The petitioner was getting pension under a Scheme for Freedom Fighters.

Learned counsel appearing for the Union of India as well as the State submit that the difficulty arises out of attestation of documents by the concerned Authority.

Upon hearing learned counsel, this Court is of the view that the difficulty is only technical in nature and the matter can be resolved by directing the petitioner to meet with the Tehsildar or Revenue Officer Senior to Tehsildar of Revenue

Department as mentioned in a Circular issued by the Ministry of Home Affairs on 17th November, 2021. The petitioner shall ensure that the documentation is in accordance with the relevant Circular. The Revenue Officer and the District Magistrate shall thereafter take necessary steps in the matter.

WPA 17663 of 2022 is disposed of with a direction on the concerned Authorities of the Union of India to release the pension of the petitioner within four weeks from the date on which necessary documents are received by the said Authorities from the end of the concerned District Magistrate. The petitioner is also directed to submit necessary documents within a period of one week from date and upon receiving such documents from the petitioner, the concerned State Authorities shall forward the same to the Revenue Officer within a period of one week from the date on which such documents are received. Since the petitioner has not received any pension from 2015 onwards, the respondents, particularly the Union of India are directed to pay arrears of pension to the petitioner from April 2015 to November, 2022 within a period of eight weeks from date.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
