D/L 12 07.08.2025 ct.no.35 Kausik W.P.A. 17168 of 2025 Debjani Sarkar

Versus

The State of West Bengal & Ors.

Mr. Sanjukta Samanta Mr. Romit Dutta ...for the Petitioner.

Mr. D.M. Mukherjee Mr. Manik Lal De ...for the State.

Learned advocate appearing for the petitioner is aggrieved by the manner in which investigation has been progressing in connection with Parnashree PS Case No. 424 dated 27.06.2025. According to the petitioner, the formal FIR and the letter of complaint are at variance, petitioners are unable to enter their residence and the petitioners have been harassed, humiliated and sexually abused because of unearthing a sex racket existing at the opposite side of the premises of the petitioner. The private respondents according to the petitioner are very powerful and as such have resisted the petitioner from entering into the premises.

State has submitted a report. Report reflects that steps were taken by the police authorities in course of investigation.

Grievance of the petitioner is not regarding the steps being taken. Grievance of the petitioner is for the atrocity being inflicted upon the complainant and her family members.

Having considered the same, I direct that the Deputy Commissioner of Police in charge of Parnashree Police Station would monitor the investigation of the case.

So far as the petitioner submits that she and her family members are unable to enter the residence, an appropriate application be made before the jurisdictional Magistrate.

Jurisdictional Magistrate will call for report from the police authorities and thereafter pass necessary directions. In case, such an application is made, the same be disposed of within a period of 30 days from filing of such application.

With the aforesaid observations WPA 17618 of 2025 is disposed of.

Report submitted be kept with the record.
