Ms. Sujata Das, learned advocate, who ordinarily appears for the State, was directed to represent the State. Her appointment may be regularised by the concerned authorities.
Report dated 23.11.2023 submitted by Ms. Sujata Das, learned advocate appearing for the State be kept on record. In respect of Tiljala Police Station Case No. 323 dated 04.11.2020 compromise was arrived by between the parties and the lady viz. Seema Tamang Bhavnani expressed her intention to withdraw the instant case. Accordingly, this Court by an order dated 24.11.2023 was pleased to quash the proceedings of Tiljala Police Station Case No. 323 dated 04.11.2020 against the husband and mother-in-law of the opposite party no.2 herein.
The present petitioners happen to be the married sister-in-law and her husband. Having regard to the fact that the case arose out of matrimonial discord and is covered by the findings in CRR 3782 of 2023, I am of the view that so far as the present petitioners being Soniya Unmesh Raut and
Unmesh Raut are concerned, the proceedings implicating them so far as Tiljala Police Station Case No. 323 dated 04.11.2020 including the charge-sheet filed therein under Sections 498A/34 of the Indian Penal Code read with Sections 3/4 of the Dowry Prohibition Act are hereby quashed.
Thus, the revisional application being CRR 2823 of 2022 along with the CRAN 1 of 2023 is allowed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
