Das Mr. Arindam Banerjee ..for the petitioners By the order impugned the application under Section 5 of the Limitation Act filed to condone the delay in filing the miscellaneous case under Order 9 Rule 13 of the Code of Civil Procedure stood rejected and consequently the miscellaneous case also stood rejected. Such an order being an appealable one, this Court is not inclined to entertain this civil revisional application.

At this stage Mr. Das, learned advocate appearing for the petitioners submits that a miscellaneous appeal has already been preferred challenging the order dismissing the miscellaneous case.

In the light of the aforesaid submissions made by Mr. Das, learned advocate for the petitioners, C.O. 2713 of 2025 stands disposed of with liberty to the petitioners to take appropriate steps in accordance with law. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
