Vaisya Mr. Suman Dey ......For the State Ms. Saswati Chatterjee .....For the WBBSE Affidavit of service is filed by the learned advocate for the petitioner showing refusal to receive the copy of the writ application by the school authority and the same is kept on record.

The petitioner no.2, an examinee of Madhyamik Examination, 2021 has alleged that she has not been given appropriate marks following the formula adopted by the West Bengal Board of Secondary Education.

Learned advocate for the West Bengal Board of Secondary Education submits that if appropriate marks are not given to the petitioner, it is the responsibility of the school and the petitioner may take up the matter with the school and the school in turn may take up the matter with the West Bengal Board of Secondary Education.

Hence, after considering the submissions of the parties, I direct the petitioner to approach the school for rectification of her marksheet, if required, which is Annexure 'P-5' at page 24 of the writ application and the school is to consider it afresh whether the petitioner is entitled to get 634 marks as has been calculated by her which is at page 25 of the writ application (Annexure 'P-6' of the writ application) and if so, the rectified marks are to be sent to the Board by the school. The petitioner is not allowed to approach the Board directly. The school is to take appropriate steps in this regard.

Learned advocate for the petitioner submits that the school authority has refused to accept the writ application. I direct the school authority to accept the writ application and go through the pleadings and to take appropriate steps as has been directed above. The petitioner is directed to serve copy of this order along with the copy of the writ application upon the school.

With the above observation and direction the writ application is disposed of.
