By an order passed on 5th September, 2016 in WP 15495(W) of 2015 a co-ordinate Bench of this Court directed the WBSEDCL to effect electricity connection to the petitioner in dag no. 464 over pole no. 14 through the distribution system for the existing supply to dag nos. 464 and 465 within 8 weeks of communication of the order. The co-ordinate Bench directed the Inspector in Charge of the local police station to aid the licensee to implement the order.
Learned counsel for the petitioner submits that the authority has not been able to install the electric connection in his premises in compliance with the said order due to stiff resistance offered by the neighbours and the brothers of the petitioner.
Learned counsel for the WBSEDCL submits that assistance was sought from the police authority but since
the petitioner failed to deposit the required police cost, no assistance was given.
The petitioner undertakes to deposit the required police cost before the police authority at the earliest. The distribution company is directed to comply with the order dated 5th September, 2016 passed by the co-ordinate Bench in its true letter and spirit within four weeks from date subject to the petitioner complying with all requisite formalities. The police authority is directed to render necessary assistance to the distribution company for installation of the electricity connection subject to the petitioner depositing the requisite cost.
The writ petition is accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
