Santanu Roy Mr. Sumit Ray, Mr. Sailen Naskar ...for the petitioners A direction to secure expeditious disposal of Title Suit No.34856 of 2014, pending before the learned XIIIth Bench, City Civil Court, at Calcutta, is the ultimate relief sought for in this case.

The only contention expressed by the petitioners is that the suit is getting delayed for frequent adjournment being granted on the prayer of the opposite party allowing him time to finish crossexamination of P.W.1, and also due to the pendency of an interlocutory application under Order 6 Rule 17 C.P.C.

No other point is raised requiring address by this Court.

In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.

Service upon the opposite party stands dispensed with.

Accordingly, learned XIIIth Bench, City Civil Court, at Calcutta, in Title Suit No.34856 of 2014 is requested to ensure expeditious disposal of the suit after causing disposal of interlocutory application referred hereinabove, providing sufficient opportunity of hearing to either of the parties to this case, but without granting any unnecessary adjournment, unless it is extremely unavoidable.

While endeavouring such exercise, the interlocutory application under Order 6 Rule 17 C.P.C. be disposed of expeditiously as possible preferably before second week of January, 2023, and the logical conclusion of the suit may be reached thereafter at an early date.

With this observation/direction, the revisional application stands disposed of.

Petitioners are directed to make communication of this order to the learned court below as well as to the opposite party and his learned advocate in the court below.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
